The Encharis et al vs ASC Petition

 

While the ASC hearing is approaching, the court date for Encharis and others v ASC in the Alberta Court of Queens Bench is also approaching. In the Encharis case the representative action respondents are petitioning the court to put the ASC hearing on hold until the representative action is concluded which could delay the ASC hearing for years.

The court will hear the Encharis petition on Mon, Sep 9, 2019 and is expected to take 1.5 hrs. If the court declines the Encharis petition, the ASC hearing starts on Sept 13, 2019. If the court finds for the Encharis petitioners, the ASC hearing will be delayed for the foreseeable future.

I’ve written about the ASC and Queen’s Bench decisions and in both instances the court found the Encharis et al arguments to be weak at best. My personal layman’s impression is that the Encharis petition is more about delaying the start of the ASC hearing to be closer to a Nov start date they originally wanted as opposed to the May start date set by the ASC panel.

Regardless of how the Lord’s left-hand kingdom authority decides, remember that they both answer to a greater power, and His justice is as perfect as it is final:
