CEF Representative Action Update: Aug 7, 2019

The Higgerty Law Lutheran Church Representative Actions page has replaced Aug 6, 2019 update. The change is largely one of rephrasing Aug 6, 2019 update.

August 6, 2019

We have filed and served the materials for the hearing to apply for certification of the Lutheran-CEF Alberta Class Action. A case management meeting with the Case Management Justice has been scheduled for October 22, 2019 to address coordinating and scheduling the steps leading up to and including the certification hearing. After that meeting, we will post a further update.

We have filed with the Court and served the materials on the Defendant’s Counsel for the hearing to apply for certification of the Lutheran-CEF Alberta Class Action at the end of July 2019. A case management meeting for the currently proposed Class Action has been scheduled for October 22, 2019 with the Case Management Justice to address coordinating and scheduling the steps leading up to and including the certification hearing. After that meeting, we will post a further update.

  1. In their April 26, 2019 update Higgerty Law stated: “Due to the sensitive stage we are presently in, we are not in a position to share any further information, at least until the Certification Materials are submitted.”

    Now, according to their August 7, 2019, update, “We have filed with the Court and served the materials on the Defendant’s Counsel for the hearing to apply for certification of the Lutheran-CEF Alberta Class Action at the end of July 2019.”

    Does this mean further information might soon be forthcoming, or would any further information have to wait until the October 22, 2019, case management meeting before Associate Chief Justice J.D. Rooke, the Case Management Judge?

My expectation is they’re working two fronts – one to negotiate a settlement with the named respondents, and second to proceed with the class action in the event the negotiations fail to yield acceptable results. If a settlement is not finalized then the next time I expect we’d hear from them would be in October.
