When I was younger it seemed like “tomorrow” was eternity to wait when I wanted something. Consequently when my Dad talked about waiting a few weeks or months it was more than my young mind could comprehend and might as well have been an eternity. Time moves on and with it life seems to move faster. What used to feel like an eternity to “young me” has become almost the blink of an eye to “older and wiser” me.
Such is the case with the Feb 2019 setback when the ASC’s original May 2019 hearing date was pushed back to Sept 2019 after respondents to the Representative Action tried to get the Court of Queens Bench of Alberta (CQBA) to put the ASC hearing on hold.
The CQBA denied this request which means their suit is still pending with the CQBA. If the CQBA hears the case before the start of the Sept 2019 ASC hearing start date and renders a decision, the ASC hearing will either have to wait for the RA to conclude, or it will start on 16 September 2019 at 9:00 AM.
Personally I give this attempt to hold up the ASC hearing as much chance for success as I’d give a snowball surviving a trip through a blast furnace, but with the courts you never know.
To summarize – in the next two months
- summer will be coming to a close (say it isn’t so!),
- the suit to stay the ASC hearing will be denied, and
- the ASC hearing will finally commence.

Update 2019-07-27: Edited to emphasize that the respondents to the representative action are trying to get the ASC hearing put on hold, not the parties to the representative action.
We have been unable to read comments for months. Where are they? Your current blog says that the Representative Action has asked for the delay. We understood from earlier blogs that it was the Respondents who asked for this. Why would we, the ‘victims’ be asking for a delay? None of us will live long enough to see any of this miserable mess resolved. But no one cares about us, so long as courts and the legal system can have their fun at our expense, everyone considers life as normal. We who lost our lives’ work will never know normal again.

You’re correct – its the respondents to the RA that have asked for the delay, not the RA. I’ll update the post to make that clear.
